Consent and Agreement

We welcome you as a user of the services provided via this Android Mobile App, iOS Mobile App Web Application and Android TV App based applications (the “Applications”) Registration

The Terms & Conditions apply to you, using the applications and all related services on the platform. You must read the Terms & Conditions carefully, and we recommend that you print and keep a copy for your future reference. By using the QTV Online Platform and any of our services, you confirm and acknowledge receipt that you have read and understood to your best knowledge and belief of these Terms & Conditions. You agree to comply with all its provisions and company policies which may be amended from time to time with prior notice or communication and made available to you. For any reason, if you do not agree to these Terms & Conditions herein, you must not use QTV Online platform or any of its services unless and until you are authorized by us the services providers .

  1. QTV Online Limited is a company registered and incorporated in the Republic of Zambia with its principal office at Plot No:1198 A, No: 16, Addis Ababa Drive, Lusaka, Zambia.

The legal agreement between you and QTV Online is made up of:

The user takes full advantage of QTV Online services, the user must download the QTV Online Application and create an Account.

  1. Once you have successful completed the registration and verification process, QTV Online limited will provide you access to its products and services upon subscription at considerable a fee.

The Terms & Conditions constitute a legally binding agreement between you and QTV Online Limited concerning your use of the platform and its content and services. It is essential that you read these Terms & Conditions thoroughly, understand to your best knowledge, and accept them as outlined. If you require legal counsel prior to accepting the Terms & Conditions, please seek such advice at your convenience and expense without prejuidice. As a registered user you will be able to use the services offered on the QTV online platform. You are responsible for maintaining the confidentiality or classification or privilege of your account and any activities that occur under your account. We will assume that anyone using the application or transacting through your account is you. Both QTV Online limited and its partners shall not be liable to any person for any loss or damage which may arise as a result of any failure or negligence or breach or misuse or misrepresentation or fraudulent or impersonation or abuse or hacking by one other person or by you to protect your password or account on the platform.

By registering on the application with your phone number or email address, you provide your explicit consent for QTV Online limited and its partners to collect and process the personal information you submit, as necessary for delivering the requested services. This processing will adhere to the terms and conditions outlined in our Privacy Policy. Additionally, by registering, you consent to receive direct marketing and promotional communications from QTV Online limited and its partners regarding products and services offered by QTV Online limited, its affiliates, and the broader group of companies associated with QTV Online Limited and its partners

QTV Online limited is a digital platform that offers Live TV, Radio, Video on Demand (VOD), as well as services through, Android Mobile Applications, IOS Mobile App, Web Application, and Android TV App. We provide a wide range of contents and services, including news, entertainments, sports, movies, politics, and business news from Zambia and around the globe.

By registering and signing into the QTV Online Digital platform, you agree to these Terms and

Conditions, and you acknowledge receipt of your acceptance of the services provided by QTV Online

Device Usage Limits

By using QTV Online, you consent and agree that:

Each account may be accessed on at least two compatible devices simultaneously, depending on your subscription plan. QTV Online may change the number of allowed concurrent devices at any time, with or without prior notice.

We reserve the right to suspend or restrict access if we detect sharing beyond authorized users, misuse, or fraud or abuse or illicit or corrupt or immoral activities or cybercrimes therefore,You must keep your login details confidential, classified and you are responsible for all activity on your account.

In the future, QTV Online limited may introduce new features that you may have access to the services on the platforms.

Changes to these terms of use

QTV Online reserves the right to change or modify, update the platform any of the Terms and Conditions at any time, in its sole discretion, by posting changes on the QTV Online web site or its digital platform. Your continued use of the services following the posting of such changes or modifications will constitute your acceptance of such changes or modifications. If you do not agree to these Terms and Conditions or any changes/updates you must not use the QTV Online platform or any of our services.

QTV Online reserves the right to discontinue the services or change the content of the services with or without prior notice for any reason. You agree that QTV Online will not be liable for any discontinuation of or changes to the services, and you understand that you shall not be entitled to any refund or suffer any liabilities for discontinuation of the services been provided for.

Your Account on This Platform

 

You agree to provide, maintain and update true, accurate, current and complete information about yourself as prompted by our registration processes (the “Registration Data”). You agree to promptly notify QTV Online of any unauthorized use of your username or other account information, any other breach of security that you become aware of involving or relating to the services. In addition, you agree to exit from your account at the end of each session. Furthermore, you are entirely responsible for any and all activities that occur under your account. QTV Online will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.

(QTV Online) terms and conditions of use and privacy policy interpretation

In the Terms, the following words shall have the meanings assigned beside them:

‘Content’ The term “Content” refers to anything that will be communicated or shared with a person or group of people via a medium the subject or ideas contained in something written, said, created, or represented shall mean any text, recorded TV and radio shows, graphics, audio, visual (including still visual images) and/or audio-visual material, including, without limitation, compilations and sequential or other aggregations of such material (such as DJ mixes, music and selected playlists of music and videos), selected memes, Live TV and radio streaming, or other multimedia content, information and material, including the metadata relating to any such content, availed or to be availed by QTV Online for viewing, listening to, downloading or streaming by you on the platform, by use of an electronic device which is capable of accessing the platform and content therein through telephone communication or connecting to the internet, including but not limited to computers, mobile phones, tablets, media players, smart TVs, and other similar devices, which devices comply with the technical requirements to access the platform and the Content. Content shall also mean a service which is provided through QTV Online to subscribers on an ondemand basis, in collaboration with other product providers, described in these Terms, that is made available on mobile devices, web, app (‘Platform as a service every day’).

‘Intellectual Property Rights’ means all intellectual property rights including patents, registered designs, trademarks and service marks (whether registered or not), rights in the nature of unfair competition rights, copyright, database right, design right and all similar property rights including those subsisting (in any part of the world) in inventions, designs, drawings, performances, business names, goodwill and the style presentation of goods and services and applications for protection of any of the above rights as provided for in intellectual property Act ,Law of Zambia 

‘Writing’, unless the context otherwise requires or it is otherwise provided in the Terms, means any form of writing and includes, without limitation, electronic mail, online messaging and any other available information transmission methods, provided that such methods are reliable and verifiable;

‘Non-Personal Information’ shall mean any information that is not Personal Information including, without limitation, any data or other information collected by QTV Online about the service and your use of the platform or any content, device information, log information, and location information;

‘Personal Information’ shall mean personal details related to your account and shall include your name, email address, telephone number or credit or debit card information. For the avoidance of doubt, a post office box number shall not be Personal Information;

‘Third – party website’ shall mean any website other than the website on which the platform is hosted and operated and ‘third party websites’ shall have the corresponding plural meaning.

‘QTV Online’’ or ‘the platform’    shall mean the ‘QTV Online’ website accessible at www.qfmzambia.com or the QTV Online platform, the ‘QTV Online’’ Android application available on Google Play Store, The ‘QTV Online’’ iOS application available on App store, the ‘QTV Online’ Windows web Phone application available on Microsoft Store, the ‘QTV Online’’ feature accessible through the What’s App feature or SMS the ‘QTV Online’ service accessible by telephone calls or SMS , used by (QTV Online) to provide the Content, ‘QTV Online’ (By whatever manner, shape or color styled) being a registered trademark of QTV Online and any other online platform which (QTV Online) shall use, in collaboration with other product providers, to provide its services and opportunities.

‘‘QTV Online’ service’ or ‘the service’ shall mean the service provided by ‘‘QTV Online’ on the platform for discovering, watching, listening to the Content, including all features and functionalities, recommendations and reviews available on the platform and the user interfaces associated therewith, as well as all content and software associated with the service or the platform.

Location

You may view the service content within the country in which you have set up an account. You may also be able to view certain Service Content in other geographic locations where we offer the Platform.

The service    

content may vary from location to location. The service Content will also change from time to tim e. You may view service content on the volume of devices specified on the platform.

Acceptance

In order to use the ‘‘QTV Online’ service, you agree and accept the Terms and Conditions. You may not use the platform if you do not accept them.

You agree to these Terms and Conditions by registering and signing into the ‘‘QTV Online’ platform or by doing such other thing as may be specified in the platform or otherwise by ‘‘QTV Online Limited.

We may, in our sole discretion, from time to time add new features or / and functionalities, change, or discontinue providing any part of the QTV Online services.

QTV Online charges the user for using QTV Online services on the QTV Online application. QTV Online may add additional, paid functionalities at its sole discretion, however the user would only be subscribed to such additional services, should the user confirm willingness to subscribe to such additional services by confirming the payment on the platform.

QTV Online may introduce or discontinue services at its sole discretion should the new Channel’s, audio, VOD or services be added to platform to be subject to a fee, QTV Online shall notify the user accordingly.

By creating a ‘‘QTV Online’ account or otherwise accessing the platform (whether by initiating a telephone call to use the ‘‘QTV Online’ service, sending an SMS, what’s app to ‘‘QTV Online’, or by any other way provided by ‘‘QTV Online’ for purposes of accessing the ‘‘QTV Online’ services. ‘‘QTV Online’ website or using such other method of accessing the services as ‘‘QTV Online’ may avail from time to time) you allow ‘‘QTV Online’ to send SMSs, What’s App for marketing and promotional material regarding this platform, ‘‘QTV Online’ services or any content therein to the email address or telephone number provided when creating your ‘‘QTV Online’ account or otherwise. In addition, and without prejudice to the foregoing, ‘‘QTV Online shall be entitled to display and otherwise broadcast to you all informational, advertisement, marketing and promotional messages in whichever way they see fit.

By displaying text, audio – visual and other forms of media within the QTV Online’ platform’s user interface.

By displaying text, audio, audio-visual and other forms of media within the Content;

Through push notifications and pop-up messages on your mobile device, email and any other ways that is lawfully communicatable to.

QTV Online can play any audio, audio – visual and any other forms of media at the beginning and at the end of telephone calls made by QTV Online for purposes of either

  • Accessing and using the service or
  • Making inquiries or responding to inquiries, as the case may be, regarding the platform or the services on the on this platform.

QTV online terms and conditions of use

You will not use the QTV Online platform or services if you do not accept the Terms  if you are legally incapacitated to enter into a legally binding contract with QTV Online. you may only use the services under supervision by a person with legal capacity; a Parent or a Guardian or legal Authority; or you are barred or otherwise legally prohibited from receiving or using any part of the Content/services under any applicable law in Zambia or Any common Law .

QTV Online provides the service using any of the following modes:

  • Through the platform;
  • Through the its website;
  • Through Telephone call;
  • Through SMS and WhatsApp or Email
  • Through Telegram 

In order to access the QTV Online platform and use the service, you will need to create a QTV Online account, with a username, with a password, phone number and email address (“You log in your credentials”). The creation of a QTV Online account permits you to purchase limited rights to the Content and services.  When creating your account, you will be required to provide certain information. You agree that you shall provide all the information that QTV Online may require you to provide for purposes of the creation of your QTV Online account. If you fail to provide the information required on the platform. QTV Online shall have the right to discontinue the service or services without any further notices or reference to you.

You shall also be able to upload content, which will be subjected to these terms and conditions. You acknowledge and agree that QTV Online reserves the sole and absolute discretion to accept or reject your request to: (a) create a QTV Online account on the platform or via the QTV Online website; or (b) receive a telephone number or otherwise access any QTV Online services.

You further agree that you are solely responsible for all activities conducted through your QTV Online account. You shall indemnify and hold QTV Online harmless from any claims, losses, or liabilities arising from any such activities without prejudice.

Your QTV Online account shall operate based on transaction value, time usage, and subscription packages. The charges for various packages shall be determined solely by QTV Online at its absolute discretion and must be paid as stipulated in these Terms and Conditions or as may be specified by QTV Online from time to time. Payment may be made as a one-off transaction or by automatic renewal, based on the option you select during your account registration.

To access and use the QTV Online services, you must have an active internet connection and a compatible device.

If you access any content without an active subscription package, or access more or highervalue content than what your subscription package covers, you hereby authorize QTV Online — in addition to any other rights and remedies available to QTV Online under this agreement or under applicable law — to charge the applicable subscription fee or the difference in charges to your account. Such amounts may be deducted, in part or in full, from any future payments made to QTV Online through your account.

You can find specific details regarding your subscription status by logging onto your QTV Online.

The QTV Online platform and all Content accessed through the service are provided solely for your personal and non-commercial use. Subject to your active subscription, QTV Online grants you a limited, non-exclusive, non-transferable license to access the platform for the purpose of viewing and listening to the Content. Downloading of Content is prohibited. Your access is strictly limited to the time, amount, and category of Content permitted by the subscription package you have paid for.

Except for the limited license granted above, no right, title, or interest in any part of the Content shall transfer to you or be claimed by you.

You agree not to use the service or any Content accessed through it for any purpose or in any manner that may:

  1. Infringe upon the Intellectual Property Rights of any person; or
  2. Jeopardize QTV Online’s commercial interests in the service or its Content.

Without limiting the generality of the foregoing, you specifically agree not to distort, manipulate, reconfigure, format, aggregate, distribute, sell, or otherwise disseminate any Content in any way, or any part thereof, accessed through QTV Online.

A breach of this clause may result, without prejudice to any other rights or remedies available to QTV Online or any third party under applicable law, in the immediate cancellation of your QTV Online account and/or termination of your access to the service.

You further agree to indemnify and hold harmless QTV Online, its officers, directors, employees, and agents from and against any losses, damages, penalties, claims, or costs whatsoever, whether arising directly or indirectly, as a result of your breach of this clause.

Use of information

Except or otherwise stated in these Terms, QTV Online shall not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent or by any written law or by courts of law or legal Authority.

QTV Online may share your Personal Information with persons who are performing any services for QTV Online including, without limitation, employees, contractors, service providers, and agents who need to know that information in order to perform such services. QTV Online shall ensure that these persons are subject to strict contractual confidentiality [ classifying] obligations with regard to your Personal Information.

QTV Online may use your Personal Information to communicate with you including, without limitation, contacting you, without limitation, by calling you, sending SMS to you, What’s App messages or displaying push notifications on your device in response to questions, solicit feedback from you, provide technical support, send marketing and promotion messages, to inform you about promotional offers, new products and incidental matters.

Whenever you contact QTV Online, may keep a record of your communication to help solve any issues you might be facing and for any other lawful purpose or incidental to..

QTV Online may use your email address, telephone number ,inform you about QTV Online services, upcoming changes, improvements, adjustments ,promotions and marketing.

If any Personal Information provided is wrong or ,erronous or mistake therefore,QTV Online shall give you ways to update it quickly or to delete it. When updating, rectifying or completing your Personal Information, QTV Online may ask you to verify your identity before acting on your update, rectification or completion request. QTV Online may at its discretion reject your update, rectification or completion request.

QTV Online may track certain information about your visits to the QTV Online platform, website and your content preferences and may use various technologies to collect and store information when you use the QTV Online platform, including using cookies or similar tracking technologies to identify your browser or device. This information may be used by QTV Online internally to improve the service and for service delivery development and marketing purposes generally. QTV Online may, at its discretion, may provide Non – personal Information to advertisers , other third parties ,any argent, servant ,whomsoever ,and/or body . No part of this privacy policy shall be read or interpreted to limit in any way.

In the event that QTV Online exercises its right to transfer its rights and obligations under the Terms & Conditions for any reason, your personal Information and Non-personal Information may be among the assets transferred. Such transfers may occur and are permitted by this privacy policy, and that any acquirer of our assets may continue to poses and use your personal Information and Non – Personal Information as set forth in this Privacy Policy.

Rights regarding the use of your personal information

You have the right at any time to prevent QTV Online from contacting you for marketing purposes.

You agree that notwithstanding the promotional preferences you indicated, QTV Online may continue to send you administrative emails, WhatsApp, text messages or push notifications including, without limitation, changes to the Terms & Conditions.

You also have the right to lodge a complaint with QTV Online regarding use of your personal

Information. Complaints must be in writing

Information protection

You acknowledge and agree that all information provided to QTV Online is at your sole risk and that while QTV Online will take all reasonable measures to protect your information, QTV Online does not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such measures or otherwise as the information may be compromised from your end by unauthorized persons who may access your account, notwithstanding the security measures put up by QTV Online to block such unauthorized access.

Your QTV Online account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use.

QTV Online may further protect your information from potential security breaches by implementing certain technological security measures as provided for by smart Zambia and other legal bodies in Zambia respectively.

Third-Party Websites

As part of the service or for any other reason, QTV Online may provide links to third-party websites or applications on the QTV Online platform. However, QTV Online shall not be responsible for the privacy practices employed by those websites and applications or the information or content they contain because QTV is not in full control of the Third part.

This Privacy Policy applies solely to information collected by us through the QTV Online platform and the service. It does not apply to your use of a third-party website accessed by selecting a link on the QTV Online platform.

If you access or use the service through a third-party website or application, then the privacy policy of that third-party website or application will apply to your access or use of that site or application.

GENERAL PROVISIONSTermination

QTV Online may terminate the legal relationship with you, and close your QTV Online account, as follows:

For convenience, with or without reason, upon giving 14 days’ notice;

If QTV Online stops providing the service (or any features within the service for any reason, upon giving 21 days’ notice. Provided that notice given generally to QTV Online subscribers shall be deemed sufficient notice for this purpose;

If you have breached any provision of the Terms (or have acted in a manner which shows that you do not intend to, or are unable to comply with the provisions of the Terms & Conditions), upon giving 7 days’ notice;

You may terminate the legal relationship with QTV Online 30days notice.

Except as otherwise provided herein, you agree that all payments made to QTV Online are nonrefundable and that QTV Online will not provide credits for any partial payments upon termination.

Upon Termination

For the avoidance of doubt, the provisions of this clause shall apply to the termination of your relationship with QTV Online and closure of your QTV Online account.

The Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Zambia.

QTV Online may at any time change any provision of, or replace, the Terms & Conditions. Provided that such changes or replacement will take effect once posted on the platform or communicated If you do not agree to the changes, you may stop using the service. Your continued use of the service after the date the change or replacement is posted on the QTV Online platform will constitute your acceptance of the changes.

Communication from QTV Online to you regarding your use of the QTV Online platform and the Terms & Conditions will be by way of text messages, telephone calls, What’s App, electronic mail, displays within the QTV Online platform and push notifications. You authorize QTV Online to use the email address and telephone number provided on your account for purposes of such communication. Provided that communication done and notices issued through any of the methods specified in this clause shall be deemed effective communication or notice for all purposes. Right of Refusal

QTV Online reserves the right not to sell its products and services to potential customers, if deemed harmful to the business activities or has information to cause harm or damage or defamation or fraud or cyber crime.
